Great new Internet Sex Sting Decision in Sarasota Case

The Second District Court of Appeal just reversed a conviction arising as a result of the Sarasota Sheriff’s 2019 Sex sting operation.  The Appeal Court has finally addressed the Entrapment techniques being used by the Sarasota Sheriff.  The issue in an entrapment case is whether or not law enforcement is creating the crime and inducing men who are not otherwise predisposed to engage in sex with minors to commit a crime.  The Sarasota Sheriff, with Ed Brodsky’s blessing, has been engaged in outrageous entrapment techniques for years.  Finally an appeal court is addressing this issue.  In the most recent decision, the defendant was not looking for a child and met the undercover detective on Meetme.com where the undercover cop originally posted as an adult. There was zero evidence of predisposition and the inducement and the luring was being done by the Sheriff’s detective.

As a sex sting lawyer, I have been blogging  for years trying to alert the public as to what the Sheriff’s office here in Sarasota has been doing.  Finally the Sheriff’s entrapment methods have been exposed.  I urge everyone to read the Second District Court of Appeal opinion in Demare v State.  You can simply Google “Second District Court of Appeal” and look at recent opinions and look for the one on Demare.  The opinion ruled that the detectives engaged in Entrapment “as a matter of law” and held that the local judge should have dismissed the case.  Hopefully, now with this opinion the local Courts will have some guidance on what is acceptable police conduct, and what is not.

The really sad thing is that the State Attorney’s office should have reigned in these tactics long ago.  The undercover detectives, particularly the ones involved in the 2019 stings, have engaged in outrageous  police conduct.  In another case, arising in this same 2019 sting,  the detectives posted as an adult prostitute, on an escort site, soliciting for prostitution.  In that case the detectives actively advertised that they were an adult prostitute, posted the hours, said they would accept cash and for all intensive purposes pretended to be an adult prostitute.  They then did their basic “bait and switch”.  That case is now working its way through the court system I have a pending motion to dismiss based on this even more outrageous police conduct.

I urge everyone to go read this opinion…Finally…the Courts are doing what the Sarasota State Attorney should have done years ago.

Is Ft. Myers in line for the next Internet Sex Sting?

There seems to be no end to the Internet Sex stings.  Now the Various Counties appear to be cooperating with each other trying to lure unsuspecting men from places like Ft. Myers and the Cape to travel the nearby County of Sarasota.  Although the police claim they are protecting the public and catching predators, nothing could be further from the truth.  Interestingly, the police have changed tactics and no longer are using the sites like Craigslist.  Now they are using Internet dating sites like Meetme.com and Grinder.com

Many of the dating sites now match people randomly through GPS applications.  For example, if a person posts a profile as a 22 year old man looking for an 18-22 year old female, and the people come in close geographic proximity,

 the application will randomly match and alert each of them.  The police take advantage of this random dating application and then when the application matches them with someone, they do the bait and switch, then saying something like “Don’t be mad, I am really 14 years old”.  They will then try and lure the guy into chatting by text, and try a lure, seduce and entice him into traveling to participate in some kind of sexual “hookup”

Never respond or chat with anyone that says they are a minor.  This is pure “jail bait” and in many instances absolute entrapment.  The best way to avoid getting arrested is to not commit a crime.  Never chat with a minor or anyone underage about anything.  The police have been targeting the gay sites like Grinder baiting men with seductive pics of teenage boys.  I have represented over forty men charged in these Sex Stings and the truth is that the police target the low hanging fruit and go after young, introverted, shy and sometimes “challenged” men who may not appreciate the seriousness of even “Chatting” or “Sexting” with a minor.

Surprisingly, many men in their thirties, forties and fifties fall victim to the Internet Sex Sting operations.  Most who fall for this, are simply lonely and seeking affirmation.  They fall for the pitch that some young woman might be interested in them.  Many travel out of pure curiosity.  So many times in these cases I see a chat where the guy says something like “you are not a cop are you?”  The undercover chatters can in fact legally lie.  A police undercover operative is under no obligation to tell you if he or she is a cop.  That is a pure myth.

The Internet is a dangerous place and the dating sites are trolled by undercover detectives seeking to set unsuspecting men up or convince them to hookup with fictitious underage girls.

The Sex Stings seem to target the Holidays taking advantage of lonely men.  Don’t take a sleigh ride to jail.  Never, no never chat with anyone underage.  No forty year old man should ever find himself being tempted by anyone pretending to be 14 or 15.  There are no real girls out there that are even remotely interested in an older guy.  Don’t fool yourself.  If you hear “ I am a Virgin, don’t even think twice.  Terminate all contact immediately.  If the undercover chatter reinitiates contact….Block them…Do not get talked into doing something you would never think of doing.

Ever since the Feds shut down Craigslist Casual Encounters and Backpage.com, undercover ICAC detectives have been struggling to create arrests. In past years, the ICAC task forces routinely used Craigslist as there number one way of entrapping unsuspecting men with their bait and switch Internet Sex Stings. This has dramatically reduced the number of arrests nationwide and particularly here in Florida. They have not run one of the normal stings here in Sarasota in quite a while.

Arrest numbers are down in internet stings and you can expect law enforcement to dream up some new way to entice unsuspecting men into compromising situations.

The other Social Media sites are now being targeted. The number one site they are using is Meetme.com. Did you ever read the “Rules of Use” for Meetme.com? You are supposed to be over 18 to be on this site. The undercover detectives are now posting profiles that are in direct violation of the rules of use. They post age regressed photographs of attractive young women, sometimes scantily clad with suggestive catch phrases. When a man responds they do the “switch” and say something like “I am only 15”. If anyone on Meetme.com ever says they are under the age of 18, you can bet, they are an undercover cop. The best way to not get arrested is to not commit a crime. Never chat with anyone that says they are a minor. Never, no never, send a sexually explicit photograph to anyone under 18.

As a sex crime lawyer, I have handled over 40 Internet Sex Sting cases all over Florida. The police are supposed to be targeting men who target children. Sadly, it is law enforcement that is targeting innocent lonely men. The police are the ones doing the luring, seducing and enticing. Here in Sarasota and Manatee County the statistics are way down and I remind everyone, never chat with anyone unless you are positive they are an adult. Do not get talked into chatting with a minor. Do not do it!
Police are also targeting the remaining escort sites, particularly in Polk County and in the Orlando and Daytona area. Normally it is only a misdemeanor to try to hook up with a prostitute. However, if the undercover prostitute claims she is 14, 15 or 16 years old, terminate all contact. They don’t call it jail bait for nothing.
